Another key difference from the era of the "Four Horsemen" is the absence of the "Three Musketeers" representing the progressive wing of the court that ended up tipping the balance of the court with the retirement of van Devanter, and the parish case. what we have today is the "Four Horsemen of reaction", the center-right in Kennedy (center being up to interpretation) The center-left wing in the from of Justices Kagan and Sotomayor, and the more liberal wing of the court in Ginsburg and Breyer. While The president isn't as bold in action as an LBJ or FDR, he is on par or at least comparable to them in vision. I believe the administration would like to appoint more liberal justices however it has now become a game of which appointment can you get through senate and score the most political points with at the same time.
